Special Circumstances

The New Jersey Department of Education recognizes several “special circumstances” that allow a student to register for public school outside the standard domicile rules. These include situations where a student is homeless; placed in a home by court order; placed by the Department of Children and Families; living with a district resident due to a parent or guardian’s active military or National Guard service or other; or residing on federal property within the district. Additional supporting documentation will be required.

Affidavit Students - Students Living With Someone Other Than a Parent or Legal Guardian

Complete the student affidavit form if the student is living with a person domiciled in the school district who is not the student’s parent or guardian. You will be asked to file a sworn statement, along with a copy of your lease if a tenant, or a landlord’s sworn statement if a tenant without a written lease.

Students with Special Circumstances - Other Living Situations

Complete the special circumstances form if any of the following apply:

  1. The student is the child of a parent or guardian who has moved to another school district as the result of being homeless.
  2. A court order has placed the student in the home of a school district resident who is not the student’s parent or guardian.
  3. The student has been placed in the school district by the Department of Children and Families acting as the student’s guardian.
  4. The student’s parent or guardian:
    • previously resided in the school district;
    • is a member of the New Jersey National Guard or the reserve component of the United States armed forces; and
    • has been ordered to active service in the United States armed forces in time of war or national emergency, resulting in the student’s relocation.
  5. The student is kept in the home of a person domiciled in the school district who is not the student’s parent or guardian, and the parent/guardian:
    • is a member of the New Jersey National Guard or the reserve component of the United States armed forces; and
    • has been ordered into active military service in the United States armed forces in time of war or national emergency.
  6. The student resides on federal property.
